TERMS OF SERVICE

This Terms of Service Agreement (“Agreement”) governs your access to and use of all products, services, programs, content, and offerings provided by Kashif Khan Official Inc.

BY ACCESSING, PURCHASING, OR USING ANY PRODUCT OR PROGRAM, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE LEGALLY BOUND BY THIS AGREEMENT.

 

 

1. DEFINITIONS

“Products and / or Programs” means all products and services offered by Kashif Khan Official Inc., including but not limited to: DNA testing services, saliva collection kits, DNA extraction and analysis performed by third-party laboratories, nutritional supplements, personalized or custom-prepared products, educational and wellness programs, coaching services, group programs, consultations, digital content, webinars, software platforms, mobile applications, websites, reports, and all related materials.

“Kashif Khan Official Inc.”, “we”, “us”, or “our” means Kashif Khan Official Inc., a corporation incorporated in Canada with its principal place of business in Mississauga, Ontario, Canada, including its affiliates, licensors, contractors, and service providers.

 

 

2. ACCEPTANCE OF TERMS

2.1 Binding Agreement

Your use of any Product or Program constitutes a legally binding agreement between you and Kashif Khan Official Inc. If you do not agree, you may not access or use the Products or Programs.

2.2 Deemed Acceptance

You accept this Agreement by:

  • (a) purchasing any Product or Program;

  • (b) submitting a saliva or biological sample;

  • (c) accessing reports, digital content, or educational materials; or

  • (d) creating or using an account.

2.3 Supplemental Terms

Certain Products or Programs may be subject to additional disclosures, consent forms, or policies, which are incorporated by reference and govern in the event of conflict.

 

 

3. CONSUMER RIGHTS (ONTARIO & CANADA)

Nothing in this Agreement limits or excludes any rights you may have under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer protection legislation.

Where this Agreement conflicts with applicable consumer protection law, such law shall prevail to the extent of the conflict.

 

 

4. DESCRIPTION AND NATURE OF PRODUCTS AND PROGRAMS

4.1 Non-Medical Services

Kashif Khan Official Inc. does not provide medical care or regulated health services. Products and Programs are not intended to diagnose, treat, cure, or prevent disease and are provided for educational, informational, and wellness purposes only.

4.2 No Physician-Patient Relationship

Use of the Products or Programs does not create a physician-patient or fiduciary relationship.

4.3 AS-IS / EVOLVING SCIENCE

All Products and Programs are provided “AS IS” and “AS AVAILABLE.” Genetic science is evolving, and interpretations may change without notice.

 

 

5. BILLING, SHIPPING, AND REFUNDS

5.1 Payment Authorization

You authorize Kashif Khan Official Inc. to charge your selected payment method for all applicable fees, including recurring subscriptions where applicable.

5.2 IMMEDIATE COMMENCEMENT OF SERVICES

Certain Products and Programs, including DNA and Gut Testing Programs, begin immediately upon execution of the Agreement and completion of payment. Services that may commence immediately include, but are not limited to:

• Ordering and shipment of testing kits
• Laboratory processing preparation
• Administrative onboarding
• Account setup
• Digital program access
• Scheduling and consultation allocation

Clients acknowledge and consent to the immediate commencement of these services upon purchase and/or signing of the applicable Agreement.

 

 

5.3 GUT PROGRAM REFUND POLICY

Gut Testing Programs require a mandatory consultation and cannot be purchased independently without consultation approval.

Upon signing of the Agreement, the Gut Program begins immediately and the testing kit is ordered and prepared for shipment to the client. Due to the immediate commencement of services, onboarding, laboratory preparation, administrative processing, and customized program allocation, all Gut Program purchases are FINAL SALE and NON-REFUNDABLE once the Agreement has been signed, except where expressly required by applicable law.

Transaction, processing, merchant, and shipping fees are non-refundable.

5.4 5 PILLARS DNA PROGRAM (“5PD”) REFUND POLICY

The 5PD Program contains both physical/laboratory components and digital educational components.

Upon signing of the Agreement, DNA kits may be immediately ordered and shipped, and digital program access and onboarding may commence.

Clients may request cancellation of the unused digital educational portion of the 5PD Program within the applicable statutory cooling-off period where required by law, provided that:
• laboratory processing has not begun;
• digital content has not been substantially accessed or consumed; and
• coaching or program services have not materially commenced.

The following items remain strictly non-refundable:
• DNA testing kits and saliva collection kits
• Laboratory and genetic testing services
• Shipping costs
• Transaction, merchant, and processing fees
• Personalized or custom-prepared products or services

Once laboratory processing, substantial digital access, or coaching/services have commenced, the 5PD Program becomes fully non-refundable except where required by applicable law.

5.6 THE HORMONES PROGRAM REFUND POLICY

The Hormones Program contains both physical/laboratory components and digital educational components.

Upon signing of the Agreement, DNA kits may be immediately ordered and shipped, and digital program access and onboarding may commence.

Clients may request cancellation of the unused digital educational portion of the 5PD Program within the applicable statutory cooling-off period where required by law, provided that:
• laboratory processing has not begun;
• digital content has not been substantially accessed or consumed; and
• coaching or program services have not materially commenced.

The following items remain strictly non-refundable:
• DNA testing kits and saliva collection kits
• Laboratory and genetic testing services
• Shipping costs
• Transaction, merchant, and processing fees
• Personalized or custom-prepared products or services

Once laboratory processing, substantial digital access, or coaching/services have commenced, the 5PD Program becomes fully non-refundable except where required by applicable law.

5.7 FINAL SALE 

Except where expressly required by applicable law, all Products and Programs are FINAL SALE once services, onboarding, laboratory processing, shipment, digital access, or coaching/program participation has commenced.

Non-refundable items include, but are not limited to:
• DNA testing kits and saliva collection kits
• Laboratory and genetic testing services
• Sterile or clean-room prepared products
• Personalized or custom-prepared items
• Supplements and nutraceuticals
• Digital programs once substantially accessed
• Coaching, consultations, and educational programs once commenced

These items cannot be returned, refunded, restocked, or resold due to safety, contamination, personalization, administrative, and regulatory requirements.

 

 

6. ASSUMPTION OF RISK & GENETIC TESTING LIMITATIONS

6.1 No Fiduciary Duty

We are not a fiduciary, trustee, or custodian of your genetic information.

6.2 Sample Processing Risks

Samples may fail due to insufficient DNA, contamination, or technical limitations. No guarantee of successful processing is provided.

6.3 No Guaranteed Accuracy

Genetic data may be incomplete, inconclusive, or revised as science evolves. You waive any right to refunds based on interpretive limitations.

 

 

7. USER REPRESENTATIONS AND CONSENTS

By using the Products or Programs, you represent that:

  • You consent to DNA extraction, analysis, storage, and interpretation;

  • You are legally authorized to submit any sample;

  • All information provided is accurate and complete;

  • You will not misuse data or attempt re-identification;

  • You understand results may be inaccurate or revised.

Any breach authorizes immediate termination without refund.

 

 

8. ACCOUNTS & SECURITY

You are solely responsible for maintaining the confidentiality of your account credentials and all activity under your account.

 

 

9. PRIVACY & DATA HANDLING

Use of the Products and Programs requires acceptance of our Privacy Policy, which complies with applicable privacy laws including PIPEDA (Canada) and other international data protection regulations where applicable.

Genetic and personal data may be stored or processed outside Canada.

 

 

10. INDEMNIFICATION

You agree to indemnify and hold harmless Kashif Khan Official Inc. from any claim arising from your use, misuse, reliance upon, or disclosure of Products, Programs, or results.

 

 

11. NO COMMERCIAL USE

You may not resell, sublicense, or commercially exploit any Product or Program without written authorization.

 

 

12. MODIFICATION OR TERMINATION

We may modify, suspend, or discontinue any Product or Program at any time without liability.

 

 

13. DISCLAIMER OF WARRANTIES

ALL PRODUCTS AND PROGRAMS ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

 

 

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, total liability shall not exceed the amount paid by you to Kashif Khan Official Inc. in the twelve (12) months preceding the claim.

This does not exclude liability that cannot be excluded under Ontario law.

 

 

15. GOVERNING LAW

This Agreement shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

 

 

16. ACKNOWLEDGMENT, RELEASE & WAIVER

You acknowledge that you use the Products and Programs entirely at your own risk and release Kashif Khan Official Inc. to the maximum extent permitted by law.

 

 

FINAL SALE NOTICE

By completing your purchase, you acknowledge that all DNA kits, sterile products, supplements, personalized items, digital programs, and services are FINAL SALE and NON-REFUNDABLE once ordered or accessed, except where required by law.
